2. What these terms apply to
These terms apply to every order you place with us. You accept them during checkout. We record which version you accepted and at what moment, so that it is clear afterwards which text applied.
3. Prices and VAT
All prices on the site are calculated by our server, not by your browser. For consumers we show prices including VAT; business customers can switch the display to excluding VAT. Where a price says "from", that is the price per piece for the quantity and material shown with it. Surcharges, such as a double grip (€ 2.95 per racket) or express delivery (€ 29 per order), are shown separately before you pay; the finish (matte, gloss or sand texture) is free. What you pay is always the amount shown at checkout.
As long as we stay below the EU threshold for distance sales, we charge Dutch VAT (21%), also for delivery to another EU country. Once we exceed that threshold, we charge the VAT rate of the country of delivery. Business customers in another EU country can enter a valid VAT number; if VIES confirms it is valid and belongs to the country given, we apply the reverse charge. If we cannot check the number or it is invalid, we simply charge VAT. We never reverse charge on the basis of a failed check.
Prices and VAT rates are frozen on the order. Later price changes in our catalogue do not affect your order.
Any promotion or discount code always states its conditions and end date. If we show an earlier price alongside a price reduction, that is the lowest price we charged for that product in the thirty days before.
4. Ordering, print proof and production
This is how every order works: you create your design (yourself in the design tool, or you send your logo and we set it up), you pay, and then you receive a digital print proof by email for approval. Nothing goes into production before you have approved that proof. If something is not right, we adjust it free of charge.
If you first request a quote or a free design proposal, you are not committed to anything. The agreement is only concluded when you accept the quote and pay. You then still receive the print proof for approval before printing.
If you do not respond to the print proof, your order waits; we do not start production on our own initiative. If you want to cancel before you have approved, we refund the full amount.
After your approval we check the file once more on the factory template. If anything differs there, you hear from us before anything is printed. From your approval onwards cancelling is no longer possible: your racket is then being made specifically for you.
5. Right of withdrawal
Rackets with your design are not covered by the right of withdrawal. When you buy at a distance, as a consumer you normally have fourteen days to change your mind. The law makes an exception for products made to your specifications and clearly intended for you personally (article 6:230p sub f under 1° of the Dutch Civil Code). That applies to all our rackets: each racket is only made and printed once you have supplied your design, and a racket with your name or logo cannot be sold to anyone else. We do not sell blank rackets.
That is why we ask you to confirm this explicitly at checkout. Without that tick you cannot order. We record the confirmation with your order.
What you can always do: until you approve the print proof, you can cancel free of charge and get the full amount back (article 4). This exception does not affect your legal rights if there is a defect; article 7 applies to that.
6. Delivery
The expected delivery time is three to five weeks, counted from the moment you approve the print proof, not from your payment. It is an expectation and not a strict deadline, unless we have agreed a fixed date with you in writing. If we cannot make it within that period, we let you know as soon as possible. You can then give us a reasonable extra period; if we miss that too, you may cancel the order and get your money back.
We deliver to all countries of the European Union. Shipping to the Netherlands, Belgium, Luxembourg and Germany is free, with no minimum amount. To the other EU countries shipping costs € 9.95 for one racket and is free from two rackets in the same order. If you choose express delivery, € 29 per order is added. Both amounts include 21% VAT; at a different VAT rate the amount excluding VAT applies (€ 8.22 and € 23.97) plus the rate of your order. We ship via a recognised parcel carrier (for example PostNL, DHL or DPD, depending on the country) with a tracking code. We do not deliver outside the EU for now. The risk of damage or loss passes to you when you, or someone you have designated, receive the parcel.
7. Warranty and complaints
You are entitled to a racket that does what you may expect of it and matches the print proof you approved. That is your legal right, and these terms do not limit it. If something is wrong with the print or the racket, or it arrived damaged, we put it right: we print or make it again, or you get your money back.
Report a defect within two months of discovering it, via info@merchpadel.com, preferably with photos. Then you are always on time. You get an answer within one working day.
Not covered by the guarantee: normal wear, damage from incorrect use, and anything that was already visible on the print proof you approved. Small colour differences between your screen and the print cannot be avoided technically and are not a defect in themselves.
Only notice a production fault after playing with the racket? Just report it: having used the racket is no reason to reject your report.
8. Your design
You remain the owner of what you supply. By ordering you give us permission to use your design to make the product and the print file.
You warrant that you have the right to have printed what you supply. Do not supply logos, brands or images belonging to others without permission. We may refuse a job if we believe it infringes third party rights or is offensive, discriminatory or otherwise unlawful. In that case we refund.
We do not use your design for our own promotion without your separate permission.
9. Payment
Payment is handled by Mollie, with iDEAL, Bancontact, Mastercard, Visa and Klarna. Your card or bank details never reach our server: you pay on Mollie's secure payment page. We always check the payment status directly with Mollie.
For orders on account, possible only by arrangement, a payment term of fourteen days applies.
10. Liability
Our liability is limited to the amount of the order concerned. We are not liable for consequential loss, such as lost revenue or an event not going ahead. These limitations do not apply in case of intent or deliberate recklessness on our part. If you are a consumer, they also do not apply to your legal rights in case of a defect (article 7), nor to the extent that the law does not allow them towards consumers.
11. Complaints, applicable law and disputes
If you have a complaint, please tell us first via the contact page, by email or on WhatsApp. We look for a solution together with you and respond within one working day.
Dutch law applies to these terms and to your order. If you are a consumer, you keep the protection of the mandatory rules of the country where you live. If we cannot resolve it together, you can take the dispute to the competent court; as a consumer you may also go to the court where you live.
12. Changes
We may amend these terms. The version that applies to your order is always the one you accepted at checkout, and we record that version with your order.
